THE PROJECT


And here we find ourselves on the home stretch leading to the celebration of the events that will constitute The Universal Declaration of Bank and Financial Service Users Rights, which will be taking place in Salamanca between the upcoming dates of September 28 to October 1.

During this time we have made our project known to the highest institutions of the State, Government, Parliament, Judiciary, political parties, diplomatic representatives holding credentials in Spain, etc. The favourable receiving and even the enthusiasm with which the invitations to participate in this event have been considered has surpassed the most optimistic of expectations.

 

Merely on an international level, apart from Spain, representatives from eighteen countries have already confirmed their assistance to this event: Argentina, Brazil, Bulgaria, Chile, Columbia, Costa Rica, El Salvador, United States, France, Guatemala, Mexico, Peru, Portugal, United Kingdom, Dominican Republic, Uruguay and Venezuela, apart from the European Commission’s Representative in Spain.

We have counted with the support and collaboration of the Town Council of Salamanca and of its University from the very beginning, with the events corresponding to presentation, reading of the text and handing-over of the original document of the Universal Declaration for its custody taking place at the premises that correspond to these institutions, the same framed as a Preparatory Event for the 15th Latin American-Iberian Summit of Heads of State and Government, which is to take place in this city on the dates of October 14 and 15.

The Universal Declaration is a document that includes the basic and fundamental rights of bank and financial service users in any country around the world. Important specialists in Constitutional Law have participated in the drafting of the document, along with the collaboration and contribution of not only AUSBANC CONSUMO’s Legal Services, but also a good number of legal services corresponding to public associations and consumer rights agencies, all of which are integrated with us at AUSBANC INTERNACIONAL.

This document has been drafted for and by the Civil Society. The document is based on descriptive considerations referring to the current situation of financial markets and on the need for financial services to exist, being subsequently developed into five chapters and fifty-four articles, in an expository and never-limiting manner, covering rights that are not only a necessity, but are of the utmost importance for development of a modern and fair society, as is the case of free competence, freedom of contracting, non-discrimination of users, improvement of the conditions in contracts, the need for a financial regulation, etc. It is so obvious that these rights can under no circumstances be waived, that the document itself has been subscribed by an important number of financial entities that will be making it their own during this event. (Banco Santander, La Caixa, Banco Sabadell – Atlántico, Banco Pastor, Caixa Galicia, Caja Duero, Caja Murcia, Bancaja, Caja Castilla La Mancha, BBK, Cajamar and Caja Laboral Popular).

Spain is a country that has developed one of the most perfect banking practices, financial system of which is providing both citizens and companies with excellent service. In our opinion the very best in the World. Unfortunately this is not the case in many countries. Our permanent contact with the Latin American Community and with some European countries has made us aware of the need and convenience to regulate and insure that a series of conducts and attitudes that are not taken into account in all societies be made a habitual practice. Thus the Universal Declaration in this sense pretends to be a reference point for the authorities, consumers and financial systems.
